Medical Marijuana Land Use Applications Must Be Submitted by June 30,2010

   On June 22, 2010, the La Plata County Board of County Commissioners temporarily lifted the moratorium on land use applications for medical marijuana businesses in La Plata County.  The moratorium will be reimposed on July 1, 2010. 

   Any individual or entity that is currently in business to cultivate, manufacture, or sell medical marijuana or medical marijuana-infused products in the unincorporated area of La Plata County because it has previously met the qualifications for a home-based business that did not require a land use permit, must now submit a pre-application to the La Plata County Planning Department, 1060 E. 2nd Ave., Durango, CO 81301, by Wednesday, June 30, 2010 at 5:00 p.m. in order to continue operating pending county land use approval and county and state licensure.

   Any individual or entity that intends to open a new business to cultivate, manufacture, or sell medical marijuana or medical marijuana-infused products in the unincorporated areas of La Plata County must submit a pre-application for specified business location to the La Plata County Planning Department by Wednesday, June 30, 2010 at 5:00 p.m. in order to be eligible to operate the business prior to the adoption of state and county licensing procedures. However, all such businesses will be required to obtain county land use approval prior to commencing operations.  This includes all grow operations (also known as “optional premises”), dispensaries (also known as “medical marijuana centers”), and infused product manufacturers, regardless of size.

   Submittal of a pre-application does not assure land use approval; it is a preliminary step in the land use approval process. Over the coming months, La Plata County will be developing land use regulations under which applications will be considered. Any person who has not completed such application shall be prohibited from operating a business for the purpose of cultivation, manufacture or sale of medical marijuana or medical-marijuana infused products until it has been licensed by the county and state licensing authority.
